A voir dire in the Court of King’s Bench in Swift Current is holding up an attempted murder case in Moose Jaw.
Joshua Adams, 28, appeared via video in Moose Jaw Provincial Court on Monday with his lawyer Andrea Urquhart appearing via telephone.
A voir dire is a trial within a trial to determine if evidence is admissible.
Urquhart told the court that the outcome of the voir dire in Swift Current could have an impact on Adams’ drug charges in Moose Jaw. She said the outcome of the voir dire is expected on Feb. 7 and asked for an adjournment to Feb. 12 to continue conversations about whether there will be a resolution or a trial.
Federal Crown prosecutor Suzanne Young said discussion will continue and efforts will be made to canvas the court for trial dates in case the trial moves forward. Young said it was her understanding that the voir dire outcome could affect whether the trial moves ahead or not but she wanted to make sure they had their “ducks in a row.”
Judge Brian Hendrickson asked if there was still an issue with knowing how long the trial would take.
Young told Hendrickson the Crown is looking at a multi-day trial. However, Young said once again the outcome of the voir dire could affect exactly how many days it could take.
Hendrickson granted the adjournment to Feb. 12 and Urquhart would elect whether the trial is heard in provincial and Court of King’s Bench at the next court appearance.
Adams, along with Gill Perrault, is charged with attempted murder following an alleged home invasion in Moose Jaw on Sept. 13. Perrault is expected back in court in April.
The Moose Jaw Police Service executed a search warrant on Sept. 14 and Adams was additionally charged with failing to comply with several release conditions, possession of proceeds obtained by crime, possession of cocaine for the purposes of trafficking and possession of fentanyl for the purposes of trafficking.
