The Crown has downgraded the murder charge for Arthur Wayne Penner in the shooting death of Colin Hough.
Penner was originally charged with first-degree murder and attempted murder. However, his charge has now been dropped to second-degree murder, which means that the killing was deliberate but not premeditated.
Hough was a Rocky View County employee who was shot and killed by Penner and Elijah Blake Strawberry on August 6 during a carjacking in Rocky View County.
Another victim, an employee with FortisAlberta, was also injured during the incident.

A manhunt began following the shooting and Penner was arrested a few days after. Strawberry was located in September by police after being on the run for over a month.
Both Penner and Strawberry are now facing charges of second-degree murder, with their next court date set for October 17. Both men are being tried together.
