The Eagle Heights Development received the green light to resume after the development permit was cancelled earlier this year.
At a hearing on March 27, Broadstreet Properties appealed the cancellation of their development permit. Following the hearing, the Subdivision and Development Appeal Board granted the appeal, allowing the original development permit to stand as issued.
Strathmore Town Council initially cancelled the development on Feb. 13, claiming there was an error in the permitting process, with the application exceeding the maximum site area in the town's Land Use Bylaw.
The cancellation came a few days after the Strathmore Bird Sanctuary Initiative presented to council, asking them to cancel the development amidst environmental concerns.
The people looking to keep the cancellation held the position that there was an error in the development permit and that adjacent landowners were not issued a copy of the permit.
The developers argued that the building had been planned for over a year and that the decision cannot be reversed because of an error in jurisdiction.
An adjacent landowner was also at the appeal hearing and expressed their concern for the impact of traffic, storm sewers, and the density of the complex.
The board listed several reasons for overturning the cancellation, including that the development acted within good faith and brought to light the issue of the maximum site area.
