With more residential development happening on the west side of Niverville, comes the need to expropriate land and this time for drainage purposes.  

So, Niverville Town Council gave 2nd and 3rd reading to Bylaw 858-23, which states.  

“Be it resolved that Council give second reading to Bylaw 858-23. A bylaw to acquire land through Consent Corporation for Public Drain in 5th Ave Estates west.” 

Councillor Nathan Dueck inquired whether the landowners affected by those properties had been notified. It was noted that the land to be expropriated had been done so with the landowner’s approval, but that those whose property was adjacent to that land, had not been notified.  

There was no further discussion from Council.  

It was also noted that the developer who was the landowner of the property from which a portion of land is to be expropriated, knows that the parcel will be used for drainage, which will not affect his plans as there are currently no buildings on it.  

The drainage ditch will be placed at the back of the Ritchot Drive properties and future Centre Street homes, with the intent of the water to flow west toward Mulberry Ave.  

Following the meeting, Mayor Myron Dueck noted that as 5th Avenue West gets developed this mutual consent expropriation needs to take place.  

“When we're looking at development and you have your engineers and your public works, you know, reviewing these different plans, sometimes there's certain things that you should have captured when you did the original layout of the particular site plan, whether it's a block of lots or whatever it is. And so, this was a detail that you know, we want to make sure that we would address, so that we wouldn't be negatively impacting any properties and that is why we're doing this.” 

Dyck confirms there are no buildings on the land the town will be using for drainage.  

“These lots at this point are vacant lots or bare lots. And so, it's a good time to do it rather than after there is housing and then trying to, you know, do swales afterwards.”  

The Bylaw received 2nd and 3rd reading and council was unanimous in voting in favour of the consent expropriation.
